1. Introduction & Agreement

Welcome to FizPays ("Company", "we", "our", "us"). By accessing or using our credit card to bank account transfer services ("Services") through our website FizPays.in or mobile application, you ("User", "you", "your") agree to be legally bound by these Terms and Conditions ("Terms"). If you disagree with any part of these Terms, you must not use our Services.

2. Service Description

FizPays provides a technology platform enabling Users to transfer funds from their credit cards to designated bank accounts within India. Key features include:

• Transfer Speed: Most transfers complete within 2-5 minutes via IMPS. NEFT transfers may take 15-30 minutes depending on bank processing times.
• Processing Fee: Starting from 0.70% + GST of the transaction amount. Exact fee displayed before confirmation.
• Supported Cards: Visa, Mastercard, RuPay, and American Express credit cards issued by Indian banks.
• Supported Banks: All Indian banks with IMPS/NEFT facility (150+ banks).
• Transfer Limits: Minimum ₹10,000 | Maximum ₹50,000 per transaction | ₹1,00,000 per day.

3. Eligibility

To use our Services, you must:

• Be at least 18 years of age and capable of entering into a legally binding contract.
• Be a resident of India with a valid Indian bank account and credit card.
• Be the authorized and lawful holder of the credit card used for transactions.
• Provide accurate, current, and complete information during registration and transactions.
• Not be prohibited from using financial services under any applicable law.

4. User Responsibilities & Prohibited Activities

You agree that you will not:

• Use the Service for any illegal, fraudulent, or unauthorized purpose.
• Attempt to bypass or manipulate our fee structure or transaction limits.
• Use stolen, unauthorized, or third-party credit cards without explicit permission.
• Engage in money laundering, terrorist financing, or any financial crime.
• Attempt to reverse engineer, hack, or disrupt our platform's functionality.
• Create multiple accounts to circumvent transaction limits or promotional offers.

5. Fees, Charges & Payments

Processing Fee: We charge a non-refundable processing fee ranging from 0.70% to 2.5% + GST based on transaction amount and card type. The exact fee is clearly displayed on the payment page before you confirm the transaction.

GST: Goods and Services Tax (GST) at 18% is applicable on the processing fee as per Government of India regulations.

No Hidden Charges: There are no subscription fees, annual maintenance charges, or hidden costs. What you see is what you pay.

Refunds: Processing fees are non-refundable once a transaction is successfully processed. In case of failed transactions due to technical errors, the full amount (including fees) is automatically refunded to your credit card within 3-7 business days.

6. Transaction Processing & Settlement

Processing Time: 95% of transactions are completed within 2-5 minutes. Settlement occurs through IMPS (Immediate Payment Service) for real-time transfers or NEFT for batch processing. You will receive SMS and email confirmations upon successful credit.

Delays: Occasional delays may occur due to bank server issues, network congestion, or RBI maintenance windows. We are not liable for delays caused by third-party banking systems.

Failed Transactions: If a transaction fails after your card has been charged, the amount is automatically refunded. No manual intervention is required.

7. KYC & Verification

As per RBI guidelines for payment intermediaries:

• Transactions up to ₹25,000 require only basic details (name, mobile, email).
• Transactions above ₹25,000 require PAN card and Aadhaar verification (e-KYC).
• We may request additional documentation for enhanced due diligence on high-value or suspicious transactions.
• Your KYC data is encrypted and stored securely in compliance with data protection laws.

8. Privacy & Data Security

We implement industry-standard security measures including:

• 256-bit SSL/TLS encryption for all data transmission.
• PCI DSS Level 1 compliance for payment card data handling.
• Tokenization - we never store complete credit card numbers on our servers.
• Multi-factor authentication (MFA) for account access.
• Regular security audits and vulnerability assessments.

9. Intellectual Property

All content on the FizPays platform including text, graphics, logos, icons, images, audio clips, digital downloads, and software is the property of FizPays Technologies Private Limited and protected by Indian copyright laws. You may not reproduce, distribute, or create derivative works without express written permission.

10. Limitation of Liability

To the maximum extent permitted by law:

• FizPays shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claim arising from the use of our Services shall not exceed the processing fee paid for the specific transaction in question.
• We are not liable for losses caused by factors beyond our reasonable control including bank delays, network failures, or force majeure events.

11. Termination

We reserve the right to suspend or terminate your access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

12. Changes to Terms

We may modify these Terms at any time. The "Last Updated" date at the top of this page indicates when changes were last made. Your continued use of the Services after any changes constitutes acceptance of the new Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.
